Article 1 Copyright
1. The intellectual property rights, including copyright, related to the information provided on the BAPE OFFICIAL WEBSITE (hereinafter referred to as The Website) operated by The Company, belong to The Company.
2. BAPE® CARD members, visitor members, and guest purchasers (hereinafter collectively referred to as members) may not use, reproduce, or publicly display these works for purposes other than personal use without permission.
3. Regardless of the purpose, if any unauthorized reproduction, redistribution, or other acts prohibited by domestic or foreign copyright laws are discovered, The Company may take legal action.
4. If a problem occurs due to violation of this article, the member will be responsible for resolving it, and The Company will not be held responsible.
Article 2 Purchase of products (use of this service)
1. In order to use the internet sales services (hereinafter referred to as The Service) provided by The Website, and to check your purchase history, you will need to join and log in as either a BAPE® CARD member or a visitor member.
2. Regardless of the type of membership, members can purchase products using The Website.
3. If a member wishes to purchase a product, they shall apply for the purchase of the product in accordance with the method specified by The Company.
4. The sales contract between a member and The Company is established when an order is received from the member and The Company notifies the member via email, etc. that the order has been accepted, or when the order is recorded in the purchase history on My Page. Even after a sales contract is established, it does not guarantee the procurement of the product. Orders will be deemed to be those of the member corresponding to the email address used. Please contact The Company if you do not receive an e-mail notification within 24 hours after applying for the purchase of a product, or if there is no information on My Page.
5. If a product ordered by a member is out of stock, The Company will not be able to provide the product, and the member shall acknowledge this in advance.
6. If a member violates these Terms and Conditions, The Company may cancel or terminate the sales contract or take other appropriate measures.
7. If The Service imposes purchase quantity limits or other restrictions on products, members shall abide by them regardless of the reason.
8. Your purchased product will be shipped to the address you specified at the time of ordering. However, delivery is limited to within Japan.
9. The Company shall not be held responsible in the event that it is unable to accept orders from members due to internet outages or other reasons not attributable to The Company.
Article 3 Payment method
1. Payment for product purchases and other items may be made by credit card (AMEX, VISA, MASTER CARD), PayPal, Shop Pay, Apple Pay, Google Pay, PayPay, merpay, deferred payment (Payday), or cash on delivery. If you use a credit card, it must be in the member's name.
2. The payment amount is the total of the product purchase price, shipping fees, and the consumption tax applied to each.
3. Depending on the product or sales conditions, some payment methods may not be available.
4. Members shall comply with the terms and conditions of a separate agreement with the selected credit card company or other payment method provider. If a dispute arises between a member and any of these third parties, it shall be resolved by both parties, and The Company shall not be held responsible in any way
Article 4 Returns and exchanges
1. Cancellations after ordering, as well as returns and exchanges after receipt of the product, are not permitted under any circumstances. However, this does not apply in the case of defective products, incorrect products, or other reasons recognized by The Company.
2. Returns or exchanges of products due to defects, etc. may only be made if the member contacts The Company within 7 days after receiving the product. Please note that if the item is out of stock, The Company will not be able to exchange the item. In this case, The Company will address the issue using an alternative method.
3. Other details regarding product returns, exchanges, and other matters shall be in accordance with separate regulations established by The Company.
Article 5 Shipping of products
1. The Company will ship the product ordered by the member within 30 business days after the sales contract is established. However, for products that exceed the above period, the delivery date will be clearly indicated in advance at the time the sale is announced. Members must agree in advance that these periods do not include weekends or public holidays.
2. Ownership of the product shall be transferred to the member when the product is delivered to the member's registered address or the member's desired delivery address.
3. Any risk after the ownership of the product is transferred shall be borne by the member.
Article 6 Maintenance of this service
In order to maintain the good operating condition of this service, The Company may temporarily suspend all or part of the provision of this service without prior notice to members if any of the following apply.
(1) In the case of regular maintenance and emergency maintenance of the computer system (hereinafter referred to as The System) used to provide this service.
(2) When operating The System becomes difficult due to fires, earthquakes, floods, lightning, heavy snow, power outages, or other natural disasters, etc.
(3) When operating The System becomes difficult due to wars, civil wars, riots, disturbances, etc.
(4) When operating The System becomes difficult due to a system malfunction, unauthorized access by a third party, a computer virus, etc.
⑸ When requested by an administrative or judicial agency based on reasonable grounds.
⑹When The Company determines that it is necessary to stop the system due to other unavoidable circumstances.
Article 7 Other disclaimers
1. The Company shall not be responsible for any damage caused by the member's inability to use The Service.
2. The Company shall be exempted from liability by processing tasks in accordance with the member's registered details.
3. The Company shall not be liable under any circumstances, regardless of the legal grounds of the claim, for any damages, losses, disadvantages, etc. related to the use of The Service or products sold through The Service.
4. If a member causes damage to another member or a third party when using this service, the member will be responsible for resolving the damage, and The Company will not be held responsible.
