Guest Purchase Terms of Use
Article 1 Application of these Terms
1. These terms and conditions (hereinafter referred to as The Terms) apply to the use of services (hereinafter referred to as The Service) provided by NOWHERE Co., Ltd. (hereinafter referred to as The Company) to individuals who do not register as members (hereinafter referred to as guests), and are binding on both The Company and guests.
2. The terms and conditions separately stipulated by the Company, such as the Terms of Use for the BAPE OFFICIAL WEBSITE (hereinafter referred to as This Site) and the Privacy Policy, shall also constitute a part of The Terms (hereinafter collectively referred to as Full Terms, etc.). In the event that the provisions of The Terms conflict with those of the aforementioned Full Terms, etc., the provisions of the latter shall take precedence, and for matters not stipulated in the latter, the provisions of The Terms shall apply.
3. Guests shall comply with Full Terms, etc. when using The Service.
Article 2 Changes to Terms and Conditions
The Company may make changes to Full Terms, etc. at any time without prior notice to members, and members shall consent to such changes in advance.
Article 3 Guests
A guest is an individual who has fully accepted the contents of the Full Terms, etc., does not apply nor log in as a member when using This Site.
Article 4 Prohibitions
Guests shall not engage in the following actions.
1. Actions that interfere or are likely to interfere with the operation of services related to This Site
2. Purchasing products for the purpose of resale, or engaging in acts considered resale.
3. Any act that infringes or may infringe on the intellectual property rights, portrait rights, personality rights, privacy rights, publicity rights or other rights of other members, third parties or our company.
4. Any act that causes or may cause inconvenience, damage, or disadvantage to our company, other members, or third parties
5. Fraudulent use of credit services to utilize The Service
6. Other actions that The Company deems inappropriate
Article 5 Termination of Service
1. The Company may terminate The Service for reasons related to service operations or other reasons.
2. The Company shall not be liable for any damages incurred by guests arising from the termination of The Service pursuant to this article.

Article 7 Use of personal information
Regarding the use of The Service, for information on how The Company handles members' personal information, please refer to the Privacy Policy on This Site.
Article 8 Jurisdiction
In the event of a dispute between The Company and a member, both parties shall try to resolve it in good faith, and if it is difficult to resolve and litigation becomes necessary, the Tokyo District Court shall be the court with exclusive jurisdiction of first instance.
Article 9 Governing law
The interpretation and application of The Terms shall be governed by Japanese law.
Article 10 Miscellaneous
The method of communication between The Company and the members shall, in principle, be conducted through the BAPE OFFICIAL WEBSITE.

Supplementary provisions
The Terms will apply to all guests from 2023 September 9.
