BAPE® CARD membership Terms of Use

Article 1 Application of these Terms
1. These membership terms of use (hereinafter referred to as The Terms) shall apply to the use of the services (hereinafter referred to as The Service) provided by NOWHERE Co., Ltd. (hereinafter referred to as The Company) to BAPE® CARD members (hereinafter referred to as members).
2. The terms and conditions separately stipulated by the Company, such as the Terms of Use for the BAPE OFFICIAL WEBSITE (hereinafter referred to as This Site), the A BATHING APE® PREMIUM VOUCHER Terms of Use, and the Privacy Policy, shall also constitute a part of The Terms (hereinafter collectively referred to as Full Terms, etc.). In the event that the provisions of The Terms conflict with those of the aforementioned Full Terms, etc., the provisions of the latter shall take precedence, and for matters not stipulated in the latter, the provisions of The Terms shall apply.
Members shall comply with Full Terms, etc. when using The Service.

Article 2 Changes to Terms and Conditions
The Company may make changes to Full Terms, etc. at any time without prior notice to members, and members shall consent to such changes in advance.

Article 3 Members
A member is an individual who has fully accepted the contents of the Full Terms, etc., applies for membership registration according to our set procedures, and whose application has been approved by The Company.

Article 4 Membership Registration
1. Those who wish to become a member shall apply for membership registration on the membership registration page of This Site according to the method specified by The Company.
2. When using a credit card within The Service, the member must comply with the terms and conditions of the credit card company chosen by the member.

Article 5 Conditions for Membership
In any of the following circumstances, your membership registration application may be declined.
(1) For people not residing in Japan
(2) If you have not approved these Terms and Conditions
(3) If there is any falsehood in the membership registration application
(4) If the product is purchased for the purpose of resale
(5) In case of application by a corporation
(6) If your membership has been revoked in the past
(7) Any other reason that the Company deems inappropriate for you to be a Member.

Article 6 Changes to Registration Information
1. If there is a change in any of the registered information, the member shall promptly notify The Company of the change in the registered information.
2. The Company will not be held responsible for members incurring any disadvantages due to failure to change their registered information.

Article 7 Prohibitions
Members shall not engage in the following actions.
(1) Any act that interferes with or may interfere with the operation of services related to this site
(2) Unauthorized use of user IDs and passwords

(3) Purchasing products for the purpose of resale or any other act that may be deemed as resale

(4) Any act that infringes or may infringe on the intellectual property rights, portrait rights, personality rights, privacy rights, publicity rights, or other rights of other members, third parties, or our company.
(5) Any act that causes or may cause inconvenience, damage, or disadvantage to our company, other members, or third parties
(6) Using the Service through fraudulent use of credit services
(7) Holding multiple accounts for the same member and combining points
(8)Other acts that our company deems inappropriate.

Article 8 Annual Membership Fees and Member Benefits
1. Members shall pay an annual membership fee of 3,300 yen (including tax) to The Company. For payment, if you make a bank transfer, the amount will be automatically debited from the bank account you registered at the time of membership. (The same applies to payment of annual membership fees for subsequent years.) If paying by credit card, please pay via the website. Any paid annual membership fees will not be refunded under any circumstances.
2. The Company provides the following benefits to members.
(1) BAPE Online shopping on the OFFICIAL website
(2) Conditional coupon distribution (irregular)
(3) Distribution of conditional coupons valid for one month after the member's birth month (once a year)
(4) Other special benefits
* Please note that the issuance of membership cards ended as of April 2020. Membership status is managed through the membership system.

Article 9 Cancellation of Membership
If a member is found to fall under any of the following reasons, The Company may immediately revoke membership without prior notice.
(1) If the reason for exclusion from membership as set forth in Article 5 of these Terms and Conditions applies
(2) If the User commits any of the acts prohibited under Article 7 of these Terms of Use.
(3) If there is a delay in payment of fees or other obligations related to the Service, an extended period of inability to receive products or services, or other default on obligations
(4) If you violate any provision of these Terms and Conditions
(5) Any other reason that the Company deems inappropriate for you to be a Member.

Article 10 Management of ID and password

1. Members shall manage their user IDs and passwords at their own risk.
2. Members shall not lend, transfer, disclose or leak their user ID and password to a third party.
3. Members shall be responsible for any damages caused by insufficient management of their user ID and password, errors in use, use by a third party, etc., and the Company shall not be held liable in any way.
4. If a Member discovers that his/her user ID and password have been used illegally by a third party, he/she shall immediately contact the Company.

Article 11 Withdrawal
1. If a member wishes to withdraw from membership, they shall promptly notify The Company.

2. The Company will not refund any annual membership fees that have been paid.

Article 12 Disclaimer
Direct mail and other communications sent to members shall be sent to the address registered by the member, and The Company shall be exempt from liability once the communication is sent to the registered address.

Article 13 Termination of Service
1. The Company may terminate The Service for reasons related to service operations or other reasons. In such cases, members will be notified in advance. However, this does not apply in emergency situations.
2. The Company shall not be liable for any damages incurred by members arising from the termination of The Service pursuant to this article.

Article 14 Use of This Site

Article 15 Use of PREMIUM VOUCHER
For details on the terms and conditions regarding how to use the A BATHING APE® PREMIUM VOUCHER issued through The Service, please refer to the A BATHING APE® PREMIUM VOUCHER Terms of Use on This Site.

Article 16 Use of personal information
Regarding the use of The Service, for information on how The Company handles members' personal information, please refer to the Privacy Policy on This Site.

Article 17 Jurisdiction
In the event of a dispute between The Company and a member, both parties shall try to resolve it in good faith, and if it is difficult to resolve and litigation becomes necessary, the Tokyo District Court shall be the court with exclusive jurisdiction of first instance.

Article 18 Governing law
The interpretation and application of The Terms shall be governed by Japanese law.

Article 19 Miscellaneous
The method of communication between The Company and the members shall, in principle, be conducted through the BAPE OFFICIAL WEBSITE.

Supplementary provisions
